Terms of Service

1. Acceptance of Terms

By accessing or using haafoto.com ("the Service"), operated by HaaFoto Ltd. ("HaaFoto," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to update these terms at any time. Material changes will be communicated via email to registered users.

2. Service Description

HaaFoto provides AI-powered passport, visa, and ID photo creation services. Our AI system validates uploaded photos against official government specifications for 202 countries and 375 document types. The Service includes: automatic background removal and replacement, face detection and positioning, cropping to country-specific dimensions, and output as JPEG files ready for government submission.

The Service operates on a self-service model. Users upload a photo, select their document type and country, and receive a processed digital photo. Expert Review add-on includes manual inspection by a trained compliance specialist.

3. User Responsibilities

By using the Service, you agree that:

  • You will upload clear, front-facing photos with proper, even lighting and a plain background.
  • The photo you upload is of yourself or a person for whom you have legal authority to submit (e.g., your child).
  • You will not upload photos containing illegal content, explicit material, or content that violates the rights of others.
  • You will provide accurate personal information including a valid email address for photo delivery.
  • You understand that AI validation accuracy depends on the quality of the uploaded photo. Photos with poor lighting, extreme angles, heavy shadows, or obstructed faces may not pass validation.
  • You are responsible for verifying that the output photo meets the specific requirements of your issuing authority before submission. While our specs are sourced from official government publications, requirements can change.

4. Compliance Guarantee

Digital orders: If your AI-processed photo is rejected by the issuing authority due to a compliance error (incorrect dimensions, background, head position, or other technical specification), we will reprocess your photo at no charge or provide a full refund. This guarantee covers technical compliance only — it does not cover rejections due to uploaded image quality issues (blur, poor lighting, facial obstruction, incorrect expression).

Expert Review orders: If a photo approved by our expert reviewer is rejected by the issuing authority due to any compliance error, we refund 200% of your payment. This is our highest-tier guarantee and reflects the confidence we have in our human-in-the-loop review process.

To claim under either guarantee, you must provide the official rejection notice from the issuing authority within 90 days of purchase. Claims are processed within 5 business days.

5. Payments & Pricing

All prices are displayed in your local currency based on your detected location. We reserve the right to change prices at any time. Price changes do not affect orders already placed.

Payment is processed securely via Stripe and PayPal. You agree to provide valid payment information and authorize us to charge the total amount for your selected service tier. All charges are inclusive of applicable VAT where required by law.

6. Refunds

Refunds are processed within 5–10 business days to the original payment method. Refund eligibility is determined under our Compliance Guarantee (Section 4). Refunds requested for reasons other than compliance rejection are evaluated on a case-by-case basis. We do not provide refunds for change of mind.

7. Intellectual Property

Our IP: All software, algorithms, website design, text, graphics, and infrastructure comprising the Service are owned by HaaFoto Ltd. and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Service.

Your content: You retain full ownership of the photos you upload and the processed photos you receive. We claim no intellectual property rights over user-uploaded or user-generated content. By uploading a photo, you grant us a limited, temporary license to process, store, and deliver it solely for the purpose of providing the Service to you.

8. Limitation of Liability

To the maximum extent permitted by law, HaaFoto Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from the Service is limited to the amount you paid for the specific order giving rise to the claim.

We are not liable for: (a) delays or failures caused by third-party services (Stripe, PayPal, email providers); (b) rejection of photos due to factors outside our control (changes in government requirements, subjective decisions by individual immigration officers); (c) any consequences of using a non-compliant photo for official purposes.

9. Account Termination

We reserve the right to suspend or terminate access to the Service for users who violate these terms, abuse the Service (including excessive chargebacks, fraudulent claims, or automated scraping), or engage in conduct that harms our systems or other users.

10. Governing Law

These terms are governed by applicable law. Any disputes arising from these terms or the Service shall first be resolved through good-faith negotiation. For EU consumers, this does not affect your statutory rights under your local consumer protection laws.
